A. The following are the terms and conditions for use of SAFARILAND HOLTZ, (hereinafter referred to as “SAFARILAND HOLTZ”) website, with domain name, www.safarilandholtz.com, www.safariland-holtz.com and www.safariland.com.na     ("the website").
B. The website is owned, hosted and maintained by SAFARILAND HOLTZ Web master.
C. By accessing and using the website, you (“the user”), agree to be legally bound by the terms and conditions as are set out in this notice. The user is therefore urged to familiarize hi / herself with these terms and conditions prior to the usage of the website. If the user does not wish to be bound by these terms and conditions, then he /     she may not access, display, use, download and/or otherwise copy or distribute any of the content of this website.

1. USER PRIVACY

To ensure acquaintance with and awareness of the privacy measures and polices of SAFARILAND HOLTZ, the user acknowledges that he / she has read and understood the underlying privacy clauses incorporated in these terms and conditions:

a) the user may visit the website without providing any personal information.
b) for SAFARILAND HOLTZ to continually assess the popularity and use of the website  and improve it for the users, the website server will collect information to measure the number of visits, average time spent at the website, pages viewed, etc.

2. USER CONDUCT

2.1 The user agrees that the use of this website will be for lawful purposes only and no modification of the material or content will be permitted.
2.2 The user agrees that he / she will not use this website for any unlawful purpose, Including but not limited to:
a) commercial purposes;
b) commission of a criminal offense (including but not limited to defaming, abusing, harassing, stalking, threatening or otherwise violating any legal rights of others;

• uploading files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another's computer;
• falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded;
d) gain unauthorized access to other computer systems, with intention to harvest or otherwise collect information about others, including e-mail addresses, without their consent; or
e) violate any applicable laws or regulations.

4. USING THE ONLINE SHOP

Via this Online shop, SAFARILAND HOLTZ sells a carefully selected range of clothing, shoes and accessories.
The ordered goods are delivered to the Customer by NAM Post.
4.1  Conclusion of Agreement and Applicable Law
a) All details published in the Online shop are without obligation and subject to confirmation.
b) To purchase one of the products presented, place it into the shopping basket. Clicking on the “Checkout” button takes you to the order form on the website, which must be completed and confirmed. You can register an account or carry on without registration. Please select a shipping method and then a payment method in the next step. Fill in your credit card details or choose transaction and confirm your order. In order to confirm your order you have to read and confirm these terms of use. If you like, you can leave us also a note.
By sending the order, you are submitting a binding offer to buy.
The handling time of your order average 5 working days.
c) The binding order may be saved to a data carrier of your choice (e.g. on your PC’s     hard drive).
You will receive an e-mail.
Safariland Holtz saves and uses the details submitted in this manner to process the purchase Agreement. Where necessary to process the payment, SAFARILAND HOLTZ shall in particular forward the data to the credit card company specified as well as to the company entrusted with the collection of outstanding payments.
d) If SAFARILAND HOLTZ consents to the order, it shall confirm it without delay. Confirmation will be sent to you by e-mail to the e-mail address specified by you in the order form.
The Agreement shall be deemed to have come about as soon as this confirmation has been delivered to the specified e-mail address.
e) The Agreement shall be governed by Namibian law.

4.2 Right of Revocation/Return
a) Customers have the right to cancel their order within 5 working days.
b) You may return the goods without stating reasons within one month by sending them back. This period shall commence upon receipt of this notification in text form (e.g. by letter/fax/e-mail), however not before the receipt of the goods by the consignee (in the case of recurring delivery of similar goods, not before the receipt of the first part delivery). Only in the case of goods that are not suitable for dispatch by parcel (e.g. in the case of bulky goods), may the return of goods also be declared in writing by requesting that the goods be taken back. A timely dispatch of the goods or the request to take back the goods shall suffice in order to comply with the deadline. In any case,     the return of the goods shall be at your own risk and for your account. The goods or the request for them to be take back must be sent to:

c) In the event of an effective return, any contributions received by either party must be returned and, where applicable, any benefits received (e.g. from use) are to be surrendered. In the event that the goods have deteriorated, compensation may be demanded. This shall not apply if the deterioration of the goods is exclusively     attributable to their examination – as would have been possible for you in a shop. For     the rest, you may avoid any duty to provide compensation for any deterioration of the goods caused by the intended use, by not using the goods as your own property and refraining from all actions that may affect their value. Obligations to refund payments     must be met within 30 days. This period shall commence for you upon dispatch of the goods or the request to take back the goods, and for us upon receipt.
4.3 Object and Form of Delivery
a) You will receive the ordered goods carefully packed.
b) The goods are sent by NAM Post.
c) The delivery time can vary from the information on our website. We have no influence on the method of operating of NAM Post.
4.4 Remuneration
a)All prices displayed are exclusive of statutory sales tax.
b) SAFARILAND HOLTZ reserves the right to the objects of the Agreement until they have been paid in full.
4.5  Material Defects
a) By delivery you shall receive the goods free of any material defects.
b) Claims owing to material defects shall come immediately after receiving and/or within a year of use. Upon expiry of the period of limitation, payment of the fee may be refused provided that you are entitled to this on the basis of withdrawal or reduction.
c) The period of limitation shall commence upon delivery of the goods.
d) You are under obligation to notify the Supplier of any defects immediately following their discovery, if possible in writing including pictures. In doing so, you should in so far as possible also state the nature of the defect as well as the circumstances in which it occurs.
e) If the Supplier is notified of defects during the period of limitation, the Supplier shall remedy these free of charge (subsequent performance).
f) Within the scope of subsequent performance, the replacement will be delivered to you again in the agreed way.
g) Following the fruitless expiry of a period of grace stipulated by you, during which subsequent performance is to take place, you shall be entitled to withdraw from the     Agreement or reduce the purchase price and demand damages in lieu of performance     or the reimbursement of fruitless expenditures.
h) The Buyer need not set a period of grace if SAFARILAND HOLTZ refuses both alternatives of subsequent performance, even if it is entitled to do so owing to the resulting costs or subsequent performance is impossible or you cannot be expected to accept subsequent performance or subsequent performance fails.
i) You shall not be entitled to withdraw from the Agreement if the defect is deemed to be insignificant. Nor may you claim damages caused by yourself or third party.

5. UPDATING OF THESE TERMS AND CONDITIONS

SAFARILAND HOLTZ reserves the right to, from time to time and at its own discretion, change, modify, add to or remove from portions or the whole of the terms and conditions. Changes to the terms and conditions will become effective upon such changes being posted to the website. It is thus the user’s obligation to at all times, check the terms and conditions on the website for changes or updates.
4.2 The user’s continued use of the website following the posting of changes or updates will be considered notice of the user’s acceptance to abide by and be bound by the terms and conditions, including such changes or updates.

6.  LIMITATION OF LIABILITY

6.1 The user agrees to access and use this site entirely at your own risk and all content on the website is provided “as is” without any warranty or condition of any kind.
6.2 SAFARILAND HOLTZ makes no representations or warranties of any kind, whether express or implied:

6.3 While SAFARILAND HOLTZ will take every effort is made to ensure that the information provided on the website is current and accurate, the user should not assume that the information on the website is always current or accurate, and other sources of this information should be consulted before making any decision to act on     the information     displayed on this website and the user acknowledges that he / she will not hold SAFARILAND HOLTZ, its parent companies, subsidiaries, affiliates, directors, employees, officials, suppliers, agents and/or representatives, under no circumstances and will keep them fully indemnified, from and against any loss or damage suffered or liability incurred in respect of any third party, which arises from the user’s use of the website, and such loss or damage may include but not limited to, liable for any defamatory, offensive or illegal conduct of other users or third parties.

6.4 The user acknowledges that he / she will not hold SAFARILAND HOLTZ, its parent companies, subsidiaries, affiliates, directors, employees, officials, suppliers, agents and/or representatives liable for any direct, indirect, punitive, incidental, consequential damages, or any damages whatsoever arising from the use of this website regardless of how the damages arise, which damages may include but not limited to:
a) damages for loss of data or profits, arising out of or in any way connected with the use or performance of the website, including but not limited to claim, demand, or damage, injury caused by any failure of performance or errors, omission, inaccuracy, interpretation, deletion, defect, delay in accessing material or content of the website, viruses, connection failures, theft, alteration of use, attorneys' fees, or any other action asserted by any third party due to or arising out of your use of or conduct on the website;
b) incompleteness of material or content on the website;
c) errors, omissions or inaccuracy of material or content on the website;
